Court ruling against bookmakers that limit

The ruling of the courts of First Instance 4 and 11 of Oviedo last July would have been of great importance for users who had been denouncing the abuse of bookmakers that for no apparent reason limit the accounts of certain customers who would have managed to win significant sums of money. The court ruling rules against bet365 and Betfair and sets a precedent although it is unclear whether it could create case law in favor of non-limiting bookmakers. We have analyzed the problem and this is our opinion since minkcafe.co .

A common practice of dubious legality

It is not difficult to find on the net complaints from users who report that a certain bookmaker gives them you have limited your account . What is it about? In accordance with the general conditions that appear in the operator's contract, the operator reserves the right to limit users in case of detecting irregularities that could relate to suspected fraud or money laundering or to problematic behavior. In most cases this leads to the cancellation of the account.

Sometimes the bookmakers limit the amount to play especially if these are markets in which the trader incurs a certain risk. They are markets of minority or unknown competitors, with generally more favorable odds for customers. By limiting the amounts to be wagered, the operator would ensure that punters do not win exorbitant sums.

It is difficult to know how these limits and criteria are established. The complaints of many users are directed against operators who, unlike bookmakers that do not limit , for no apparent reason restrict or cancel the account to players who would have won significant sums by legally betting in New Zealand. In recent months the complaints were, above all, directed against the bookmaker bet365, an operator that boasts of being one of the most reliable and successful in the world .

Court ruling fails against bet365 and Betfair

For many bettors, making money through betting is a reality. It just depends on the information available and how you play with the odds, especially in minor and little-known markets in which the conditions are more favorable for bettors . Here the famous ones come into play tipsters or betting tipsters who, however, have been also denounced for not a few frauds .

The judgment that came to light in July ruled in favor of two users of the bet365 bookmakers and Betfair that they would have seen their accounts limited with restrictions on the amounts to bet. The court ruling would have established that the aforementioned operators would not have the right to apply the clauses contemplated in the general conditions of the contract with the client and that allows them to restrict and/or cancel an account. The general complaint of users is that bookmakers would not like winning customers.

The sentence would have declared such unfair terms . It remains to be seen whether the ruling will create jurisprudence, as there is a similar ruling against bet365 in 2019 . In the opinion of some experts, such a ruling is difficult to apply and it is also not very clear about the terms and conditions in the operator's contract and their legal applicability in New Zealand, when it comes to clauses taken from Anglo-Saxon jurisprudence.

The background of the problem

Some of the users who have denounced these abusive practices boast on the network of having won considerable sums of money thanks to their expertise with betting. From the Directorate General for the Regulation of Gambling (DGOJ) and the portal Play well the Spanish regulatory authority does not tire of warning about the terrible effects of treating gambling as a business instead of leisure and entertainment . There is no doubt that this is also the position of the operators who have come working on strengthening safe gaming systems and responsible.

Judgments in favor of users against the practices of bookmakers have happened throughout the year and have served as a claim generating a legal industry of lawsuits against bookmakers . The main argument is the unfair treatment of the operator in front of users on a roll . But is there such a thing as the streak in gambling ? We are quite skeptical about it.
